PTC to pay PLN 2m fine

The Office of Electronic Communications (UKE) has imposed a PLN 2m (€0.53m) fine on PTC, the operator of the Era mobile network, for irregularities in the introduction of new rules of service provision.
The company announced, on 15 March, a change in the rules which related to complaints. The regulator stated that the rules were altered and that subscribers were, therefore, entitled to give up a subscription without having to pay contractual penalties if they did not approve of the change. The operator insisted that this was merely an “adjustment” and that it does not confer a right to terminate the contract. The UKE ordered PTC to send the new rules to the subscribers along with information on the right to abandon the operator. The latter argued that this might be used by subscribers who have recently bought a handset or a notebook for the promotional price of PLN 1 (€0.26) and they are repaying the loan thus paying for the hardware and now could terminate the agreement without returning the computer of the handset.

The regulator expects that PTC will challenge the fine in court. Anna Strezynska, the UKE’s president, quoted by Gazeta Wyborcza, said that the Telecommunications Law, which allows the subscriber to leave the operator after any change to the rules of provision, is not perfect. She stated that the court would have to interpret the regulation.

The operator has refrained from commenting on the fine, as it has not received official notification.
