UKE loses a case in Court of Justice over TP SA regulations

The Office of Electronic Communications (UKE) lost a case in the EU's Court of Justice over the attempt to regulate the retail prices for the broadband Internet access provided by TP SA. In accordance with the ruling, the UKE broke the EU’s telecommunication law as the office did not have the right to regulate the prices without previous market analyses.
Since May 2006 the UKE has investigated the retail prices for broadband Internet offered by TPSA and in 2007 it fined the telecom around PLN 340m (€85m).
In the conflict with the European Commission that began in 2007, the UKE insisted that it wanted to fight monopoly and ensure the broadband Internet access is affordable for Polish customers.
